The Motor Vehicles Act of 1988 established the Motor Accident Claims Tribunal. It was established so that people injured in car accidents would have easier access to justice. The Motor Accidents Claims Tribunal no longer falls under the purview of the Civil Courts. The High Courts hear appeals from the Claims Tribunal. Time is of the essence, thus the appeal must be lodged with the High Court within 90 days of the date of the Claims Tribunal’s ruling. though the High Court is convinced that the appellant had good reason for missing the deadline, it can hear the appeal even though it wasn’t filed within the statutory period of ninety days. (Section-173). However, there is no statute of limitations on claims arising from car crashes. But the Tribunal will have to explain itself if the delay is extraordinary. Compensation may be sought by any of the following parties, as set forth in Section 166 of the Motor Vehicles Act,1988: the injured party; the owner of damaged property; the legal representative of the deceased party; the authorized agent of the injured party or the legal representative of the deceased party. And the assertion Any of the following Claims Tribunals can be petitioned: the one with jurisdiction over the location of the accident; the one in which the claimant resides or maintains an office; the one in which the defendant maintains an office.
